BMC attacks ServiceNow for patent infringement

As a long-term participant in the field of incident and configuration management, BMC Software has filed a lawsuit against ServiceNow, accusing it of infringement of 7 patents related to several of its products.

ServiceNow is a publisher of SaaS solutions specializing in incident and configuration management. Its customers include Saint-Gobain, LVMH, BNP Paribas and even SNCF, and are the target of its competitor BMC Software. The latter did lodge a complaint against its 7 patents for multiple products in incident and problem management, analytical performance and configuration management. The ServiceNow configuration management database solution is particularly favored by BMC Software.

BMC Software pointed out in a complaint filed with regional jurisdictions that when others use its patented technology for free and provide patented technology at a below-market price without recovering the standards of R&D investment undertaken, BMC’s ability to innovate will be scorned. Claim losses and interest

ServiceNow allegedly infringed patents related to the process and system of configuration management database software license compliance, the system and method of evaluating and reporting component health, and the interface external parameters in the performance management system.

The publisher also criticized ServiceNow for hiring former key employees (including engineers and sales staff) to develop key aspects of its service automation platform products and related products, some of which include features that infringe its patents. He seeks damages and permanent injunctions for ServiceNow and its executives involved in these alleged patent infringements.
